MICHAEL CESARANO is a Registered Patent Attorney who serves as the Head of the Patent Prosecution Department.  Mr. Cesarano concentrates on patent prosecution, intellectual property litigation, and the national and international registration of various forms of intellectual property, particularly computer and internet technology.

Mr. Cesarano began his career as a pilot in the United States Marine Corps.  Combining his experience as a general litigator with his military aviation background, he worked as a patent attorney at Boeing Commercial Airplane Company before going into private practice.

Mr. Cesarano received his L.L.M. from the University of London, his J.D., cum laude, from Seattle University School of Law and his B.E.E. from the University of Virginia.  Mr. Cesarano is AV rated by Martindale-Hubbell , and board certified in Civil Trial and Business Litigation by The Florida Bar.  He is also a Florida Supreme Court Certified Circuit Mediator.  In addition to being a member of the U.S. Patent and Trademark Office, Mr. Cesarano is admitted to practice law in Florida, Pennsylvania, and Washington. Additionally, he is a member of the American Intellectual Property Association, the American Bar Association and the Federal Bar Association.

NOTABLE CLIENT WORK

  • Ron Matusalem & Matusa of Florida, Inc. v. Ron Matusalem, 872 F.2d 1547 (11th Cir. 1989). Represented the plaintiff in a trademark infringement based upon the defendants failure to adhere to quality controls set forth in the trademark license.  The defendant was required to adhere to the quality control standards dictated by licensor.
  • Jaswant S. Pannu and Jaswant S. Pannu, M.D., P.A. v. Iolab Corporation, 155 F.3d 1344 (Fed. Cir. 1998).  Won a jury verdict in favor of client against Iolab Corp., a subsidiary of Johnson & Johnson, in a case alleging patent infringement.
  • Novo Industries, LP v. Micromolds Corporation, et al., 355 Fed 3rd 1348 (Fed. Circuit 2003). Represented defendant accused of infringing patent.  In the lower court, jury found liability based on judges erroneous instruction.  This was reversed on appeal because the patent was held to be invalid.
  • Triarch Inc. v. Trans Globe Lighting, Inc., District Court, S.D. Fla. Represented Defendant accused of infringement of the plaintiffs design patent.  The trial court misinterpreted the patent and found infringement.  On appeal to the Court of Appeals for the Federal Circuit, the trial court judgment was reversed, the Court of Appeals finding that the judge had not understood the patent, and holding that there was no infringement.
  • Bageland, Inc. v. Rachael, Inc., U.S. District, S.D. Fla. Represented client who was a franchisee of Bageland, and was authorized to operate a restaurant under that name.  After Bageland permitted another restaurant to operate within the clients exclusive territory, client terminated the franchise and changed the name of its restaurant.  The trial court found the franchise to have been validly terminated.  On the plaintiffs appeal to the 11th Circuit Court of Appeals, the decision was upheld in all respects.
  • Arbitrates internet domain name disputes under auspices of International Corporation for Assigned Names and Numbers (ICANN)
  • Handles administrative proceedings within the USPTO for trademark oppositions and cancellations and patent prosecution issues.
